A grand jury found the “deadly response” of the incident to be the result of necessary use of force.

Klamath County Sheriff Shane Mitchell and Deputies Tyler Vickery, Terry Brown and Robert Langfield were in Collier Park on Dec. 23, 2024, attempting to arrest a man with a warrant for assault and weapons charges.

Joseph Michael Tancredi, 35, was killed in the incident.

A news release from the Klamath County District Attorney’s Office said law enforcement informed Tancredi that he was under arrest.

“Tancredi then produced a handgun and ordered the deputies to leave,” the release reads.

When Tancredi was instructed to lower his weapon, he refused and began shooting at the deputies.

“The deputies returned fire with their patrol rifles and Tancredi took cover behind trees and other debris,” the release said.

Tancredi suffered multiple gunshot wounds, including one self-inflicted shot to his skull.

Law enforcement and emergency responders were able to get Tancredi to Sky Lakes Medical Center. He was then transported to Bend for emergency medical intervention but succumbed to his wounds.

The District Attorney’s Office said Dr. James Olson, with the Oregon State Medical Examiners’ Office, “ruled that Tancredi died from the gunshot wounds received during his encounter with deputies.”
